Calculating a child support obligation involves more than determining monthly net incomes of the parties or looking at the schedule in Pennsylvania Rule of Civil Procedure No. 1910.16-3. Many factors, circumstances and issues may be relevant in a particular support case and hence the consideration of them necessary in calculating the support obligation. I will review the support guidelines with my clients and let them know how deviations, circumstances and issues might apply. The Pennsylvania support guidelines require that the special needs and obligations of the parties to a support proceeding be considered. The trier of fact in a support proceeding may determine that the amount of support deviates from the amount of support determined by the guidelines.

In a child support proceeding, factors, issues, circumstances and needs and obligations of the child or children and parties may include but not be limited to: child care expenses, summer camp expenses, insurance premiums for medical, health, dental and vision coverage, unreimbursed medical, health, dental and vision expenses, educational expenses, perquisites of employment, the number of overnights each child spends with a parent or party, needs of the child, earning capacity or earning potential of each party, the amount of the mortgages, home equity loans, real estate taxes and homeowners’ insurance and other obligations incurred during the marriage which are secured by the marital residence, dependency tax exemptions, the different types or amounts of income in addition to what appears on tax returns or pay stubs or wage statements or independent contractor documents, multiple families, other support obligations of a party, who is living in the marital residence, other income in the household, ages of each child, assets and liabilities of the parties, standard of living of the parties and the child or children and other special or unusual needs and obligations of the parties and each child, the best interests of the child or children.
